Positive Side of the Fifth Amendment

Positive Side of the Fifth Amendment
By Rudy Chong

After the wrong decision of the Supreme Court to deny justice to Dred Scott who was a slave and sent back to Wisconsin which was a free state, Civil War took place. Dred Scott Decision provided the fuel of vexation to African American community which exploded in protest against the wrong judgment by depriving Dred of his legal status as American citizen because of his low status as a slave. Civil War ended with the fall of the servitude and slavery.

This civil war brought back the right to the African American community to live independently shrugging off the stigma of the slavery. After defeating the rivals, the leaders of the black community started planning how to reconstruct the nation in new way. Till the occurrence of the Civil War, the act of brutal slavery was legal and socially acceptable but after the battle the nation would have to accept the new challenge by abolishing the bonded labor and servitude.

The thirteenth amendment empowered the black community to eliminate the slavery from the society forever. Again with the fourteenth amendment, the special protection was given to the black community against the slavery. This amendment was very effective to strengthen the black community to resist slavery. However the fifteenth amendment is very powerful legal tool which modified the law in regards to the human rights for the African American community.

Better to say, it is much more powerful and elegant which will ensure the legal rights of the black people to cast votes and participate in the nation building activities. According to the fifteenth amendment bill, no state in the United States will block the right to cast vote on the basis of color distinction, racial segregation and creed. With the enactment of new laws, the American African people got the legal status to choose their representatives through the referendum or election process. You will be glad to see that for first time the black community was given the power to go to the election center or booth for casting their votes according to their choice.

You should know the name of Thomas Mundy Peterson who was the first representative of the black community moved to the school for electing the management of the school board in Perth Amboy which is located in New Jersey. Since then a number of national heroes have emerged form the black community to enrich the American society. They are eminent scholars, physicians, Nobel Prize winners and athletes. Colin Powell, Condoleezza Rice, Barrack Obama are some of the excellent figures who have possessed the prestigious portfolios in the society. All these celebrities are black in color but their elegance and quality are undoubtedly remarkable.

“Life, liberty, and property do not exist because men have made laws. On the contrary, it was the fact that life, liberty, and property existed beforehand that caused men to make laws in the first place.” -Frederic Bastiat
